How the federal record-keeping requirements for sexually explicit visual content relate to KinkGPT.
KinkGPT is a private service for adult couples. Aphryl Labs OÜ does not produce, commission, or publish sexually explicit visual content. The KinkGPT assistant generates text only; no visual content of any kind is generated or produced by the platform. To the extent 18 U.S.C. 2257 and 2257A apply to any material submitted by users, Aphryl Labs OÜ is not a primary or secondary producer within the meaning of 28 C.F.R. Part 75; it operates as a provider of an interactive computer service, and users who produce content are solely responsible for it and for any records the law requires of producers.
Exchanges between connected partners are private communications between two members who have affirmed they are 18 or older; they are not published to anyone else. On the creator marketplace, proof images are non-explicit by default. A sexually explicit proof image is permitted only between a creator specifically approved for it by our team and an applicant who has affirmed being 18 or over, and every such image is held for human moderation before it is released to the creator. Age is affirmed at sign-up and re-confirmed on return.
Content that depicts, impersonates, or is based on a real person without their consent is prohibited everywhere on KinkGPT. Any sexual depiction of a minor, real or simulated, is met with zero tolerance: content is removed, accounts are terminated, and reports are made to NCMEC and law enforcement, as set out in our Trust & Safety policy.
